Section 2-31(4) of the Fort Smith Municipal Code states, "Any item of business may be denied a place on or removed from the agenda by notice of four directors to the city clerk prior to the date of the meeting of the proposed consideration. The city clerk shall immediately notify the city administrator, the mayor, the directors and other interested persons of such action."
Pursuant to the above, Director Christina Catsavis contacted the City Clerk's Office at approximately 12:30 p.m. and requested the removal of the following item from the February 7, 2023 regular meeting agenda:
4. Ordinance prohibiting the transfer of animals within the corporate limits of the City of Fort Smith; amending Article IV, Section 4-96 of the Fort Smith Municipal Code and Section 27-701-3E of the Unified Development Ordinance; and, establishing a penalty for violation ~ Morton/Settle placed on agenda at the November 10, 2022 study session / Tabled to the February 7, 2023 regular meeting at the January 3, 2023 regular meeting ~ (Administration)
All remaining directors were contacted and advised of the request. Director George Catsavis concurred with requested removal; however, Directors Jarred Rego, Andre' Good, Lavon Morton, Kevin Settle, and Neal Martin did not.
Since the request did not obtain the required concurrence of four (4) directors, the aforementioned Item No. 4 will remain on the February 7, 2023 regular meeting agenda for consideration.
